Terms and Conditions

By payment of tickets in full or the booking deposit to confirm your charter booking, you are entering into an agreement to honour the following terms and conditions of business. You acknowledge that you have read the Sea Sydney Harbour terms and conditions in full.
Your cruise on Sydney Harbour includes activities that may involve considerable risks and dangers. Whilst care is taken to ensure your safety on board and in the water, we accept no responsibility for injury, damage or losses incurred.

General Conduct & Safety

  • Always obey the safety instructions given by the skipper or other crew members.
  • Only exit or board the boat once the skipper has advised it is safe to do so.
  • You must advise the skipper if you are not a confident swimmer.
  • You declare that you are in a fit and healthy state to undertake the events of your cruise and that you have no pre existing medical condition or injury which would affect your competence on the boat or water.
  • You must inform Sea Sydney Harbour prior to your cruise date if you have any food allergies or health conditions which may affect your safety on the cruise.
  • Jumping/diving from the boat is dangerous and not recommended. You do so at you own risk. Jumping/diving from the roof of the boat is not allowed.
  • Access to the roof of the vessel is not allowed.
  • Always use sunscreen and drink lots of water.

Service

  • The skipper reserves the right to end the charter booking at any time should passenger conduct be deemed inappropriate or there is any evident damage to the vessel. No refund will be offered.
  • The passenger who has booked the cruise will be responsible for the cost of all damages and breakages caused by passengers.
  • The skipper reserves the right to refuse boarding of a passenger or offload a passenger from the vessel if they are deemed to be intoxicated or under the influence of illegal substances. No refund will be offered.
  • Alcohol will be refused to any intoxicated passenger and is only to be consumed by people 18 years of age or older. Passengers are advised to obey alcohol consumption RSA guidelines of no more than 6 standard drinks in one day.
  • No illegal substances are to be brought on board.
  • Offensive behaviour will not be tolerated.
  • Passenger numbers are limited to 30 people, including children. The skipper reserves the right to refuse entry to any passenger numbers above 30.
  • If you are under the age of 18 or under any disability you must be accompanied by a parent or another adult person who is responsible for you during the charter.
  • It is the responsibility of the parent/adult person to supervise children under 12 at all times.
  • Sea Sydney Harbour may photograph some of your charter for use on their website and/or social media. Please inform the team prior to your cruise date if you do not wish to have images from your charter shared online.
  • When booking with Sea Sydney Harbour, your email address will automatically be added to our mailing list to receive the Sea Sydney Harbour Newsletter. Please advise the team if you do not wish to be added to the mailing list.

Charter Bookings

  • All terms and conditions listed under 'General Conduct & Safety' and 'Service' apply to charter bookings.
  • A 50% non-refundable deposit is required to secure your booking. Until the deposit is paid, a booking cannot be guaranteed.
  • The remaining balance of the charter fee must be paid 2 weeks prior to your cruise. If the balance has not been made within 10 days of the scheduled cruise date, Sea Sydney Harbour reserves the right to cancel the charter with no deposit refunded.
  • Date changes/cancellations within 48 hours of the charter date incur a 100% fee and no refund will be offered.
  • Date changes/cancellations between 48 hours and 10 days of the charter incur a 50% rescheduling/cancellation fee.
  • All date changes and cancellations must be made in writing and emailed to info@seasydneyharbour.com.au.
  • If Sea Sydney Harbour deems the weather conditions unsafe, your charter will be rescheduled. No refund will be offered.
  • Sea Sydney Harbour has the right to substitute a vessel for one that has similar features.
  • Should there be any safety issues with the vessel that cause your charter to be cancelled, you will be given the option to reschedule or receive a full refund.
  • Quotes are valid for a period of 3 months.

Harbour Boat Tours

  • All terms and conditions listed under 'General Conduct & Safety' and 'Service' apply to harbour boat tour bookings.
  • All tickets are non refundable and non transferable and your ticket cannot be guaranteed until full payment has been made.
  • Cruise schedules are dependent on minimum passenger numbers of 8 and may vary according to special events held in Sydney. Tours are available daily by request for group bookings of 10+ adults (dependent on vessel availability). Smaller group bookings will be at the discretion of the Sea Sydney Harbour team.
  • Tours may not run on Public Holidays or on other nominated special events. If running a 15% surcharge applies. Availability of tours may vary during the Vivid Sydney Festival and other Sydney Event times.
  • Cruise times include boarding time and disembarkment.
  • Cruise routes are a guide only, weather dependent and subject to change without notice. Site stops may be impacted by weather and are left to the skipper’s discretion on the day.
  • Please arrive at the pick up location 20 minutes before departure time. If a booking is made and you do not show up or arrive late, Sea Sydney Harbour reserves the right to cancel or void your ticket and cannot guarantee tour participation on an alternate cruise time.
  • Price includes morning tea, lunch, island landing fees and GST.
  • Quotes are valid for a period of 3 months.
  • Child (3-12 years); Senior (valid concession card must be presented); Family (2 adults, 2 children up to 12 years). Passengers of all ages must be accounted for to ensure the maximum survey number is not exceeded.
  • You must inform Sea Sydney Harbour when making a booking if you have any food allergies or health conditions which may affect your safety on the cruise.
  • Sea Sydney Harbour will not be held responsible for any personal injuries, equipment loss or damage sustained while participating in a tour. Passengers may get wet, and are advised not to carry any valuables on them.
  • If Sea Sydney Harbour deems the weather conditions unsafe, your tour will be rescheduled. If a tour is cancelled, Sea Sydney Harbour will attempt to reschedule the cruise at no cost or a credit voucher will be supplied.
  • Sea Sydney Harbour has the right to substitute a vessel for one that has similar features.
  • Should there be any safety issues with the vessel that cause your charter to be cancelled, you will be given the option to reschedule or receive a full refund.
  • The Historical Gems tour includes walking activities (optional); please wear appropriate footwear. Medium fitness level recommended.
  • The Harbour Beaches tour includes water activities (optional); please bring towel and swimmers.
  • The beverage supplied on the Sunset & Sparkle tour is non-alcoholic, however customers are welcome of BYO alcoholic beverages.

Special Events - Vivid Sydney and New Year's Eve Harbour Cruises

  • All terms and conditions listed under 'General Conduct & Safety' and 'Service' apply to special event bookings.
  • All tickets are non refundable and your ticket cannot be guaranteed until full payment has been made.
  • Cruise times include boarding time and disembarkment.
  • Please arrive at the pick up location 20 minutes before departure time.

  • Suggested parking rates are specifically applicable to Wilson Parking Barangaroo and are valid for weekends & public holidays, with entry after 5pm and exit before midnight. Pricing is correct at February 2017, however may be subject to change. It is the responsibility of each customer to ensure that are aware of charges associated with all public parking.
